탐정업 관리제도의 입법방향에 관한 연구
그간 국회에 제출되었던 민간조사업 관련 법안은 모두 회기 종료로 폐기되고 금번 20대 국회에서 윤재옥, 이완영의원의 공인탐정법안 2건이 발의되어 있다. 탐정업 관리제도가 도입되어야 한다는데 대해 정부부처는 물론 학계에서도 큰 이견이 없었 다. 그럼에도 불구하고 입법이 이루어지지 않은 것은 탐정업의 본질적인 법적 성격 에 대한 이해가 부족하여 퇴직경찰 일자리 창출 등 부수적 효과를 앞세운 것 등에 원인이 크다고 할 수 있다. 윤재옥의원안(2016)의 제안이유에서와 같이 탐정업은 우리나라만을 뺀 OECD 34개 국 모두 금지하지 않고 있고 각 나라의 실정에 적합하게 자격인증·교육·영업등록등 여러 관리시스템을 통해 국민의 권익을 보호하기 위한 탐정업의 장점은 활용하면서 프라이버시권 침해 등 단점은 최소화하고 있다. 우 리나라도 오류입법으로 인해 금지된 탐정업 서비스를 다른 선진국과 같이 적정한 관리·감독으로 수요자가 탐정 업 서비스를 믿고 이용하게 하고, 사생활 침해 등 부작용을 방지하기 위한 적절한 관리제도를 마련하여 국민의 권리보호와 탐정업의 건전한 발전을 도모하여야 할 때 다. 이를 위해 법학자 및 법조계 특히 경찰행정법 관련 학자들을 중심으로 보다 많은 연구가 이루어지고, 관련 학회·변호사 단체·관련 부처·국회 등이 공동으로 세미 나와 홍보를 함으로써 입법을 앞당겨야 한다.
A Study on the Legal Introduction of the Private Investigation System in Korea
Proposed bills of private investigation had been abandoned due to ending of national assembly session and the two draft bills have been proposed by congressman Yun Jae Ok and Lee Wan Young. Introduction of private investigation is agreed by government agencies and academia. However the delayed legislation has been caused by lack of understanding on the characteristics of legal concept on the private investigation and by only focusing on side effects such as creating jobs for retired police officers. Like as the draft bill explanation proposed by congressman Yun Jae Ok(2016), except for South Korea, all 34 nations of OECD members allow private investigation and with various management systems for qualification recognition, training, registration and others, benefits of private investigation have been utilized and shortcomings of that such as infringement on privacy have been minimized. This is right time to adopt the private investigation service with proper management and supervision like as developed nations for customers relying on the service, for preventing negative effects including violation of privacy for citizens’ right protection and development of the service. For this goal, more researches by police administration law related scholars academic are required and it is better to speed up legislation by advertisement and seminars with related academic communities, congress, public and private agencies.
